Public Protector Mkhwebane says the DA’s accusations against her were baseless

Public Protector, Busisiwe Mkhwebane says when the Democratic Alliance’s (DA) spy allegations against her failed to materialise, the party started writing letters to the former National Assembly Speaker,  Thandi Modise.

She says the DA initially wanted her to be removed for incompetence and not for her fitness to hold office.

This is mentioned in her responding affidavit to challenge the applications for direct access in the Constitutional Court to appeal a High court ruling that was in her favour.

Both the DA and the Speaker want to be granted direct access to appeal the ruling by a full bench of the High Court in Cape Town in the Constitutional Court.

The high court ruled in favour of Mkhwebane on two constitutional grounds which related to the separation of powers and her right to have legal representation during a parliamentary inquiry into her fitness to hold office.

In her responding affidavit, Mkhwebane says the DA’s accusations against her were baseless. She says they stemmed from court cases against her and utterances made by judges in such cases.

Mkhwebane also says the Modise constantly failed in her constitutional duties to be impartial. She says Modise continued to accept the DA motions for her removal from office even when the rules for the removal of a head of a Chapter 9 institution were not in place.

The matter will be heard in the constitutional court on Monday.

Wandile Bozwana murder trial resumes in Pretoria

The High Court in Pretoria will on Wednesday resume with the trial of four men charged with murdering North West businessman Wandile Bozwana in October 2015.

Last week, the defence requested a postponement for more time to arrange for cellphone forensic evidence and consultation with their clients.

The defence argued that the MTN maps locating the suspects’ whereabouts at the time of the murder are crucial for the trial.

Sipho Hudla, Robert Mutapa, Bonginkosi Khumalo and Mamelodi businessman Vusi “Khekhe” Mathibela are also facing a charge of attempted murder, possession of unlicensed firearms and ammunition.

Bozwana’s colleague Mpho Baloyi escaped after being shot several times when the car she was travelling in with Bozwana was shot at by heavily armed assassins at Garsfontein, east of Pretoria, in October 2015.

All accused are remanded in custody.

Fuel price hikes kick in on Wednesday

Substantial fuel price hikes have taken effect starting at midnight last night.

The Mineral Resources Department earlier announced an increase of R1,21 cents a litre for petrol with diesel increasing by R1, 48 cents a litre.

Wholesale illuminating paraffin is go up by R1,45 cents a litre.

The Automobile Association says refinery costs, natural gas price hikes and rand weakness are behind the steep increases in the run up to the festive season.

Consumer specialist, Ina Wilken says this is bad news for consumers: “The petrol price increase of this magnitude does not go down well for cash-strapped consumers. The price of petrol which before the increase is R8,18 and what we then pay at petrol stations for 95 Octane for example at R18,33 of which R6,33 goes to the state added to that cost such as transport, storage and other discretionary costs etc which then add to R18,33 today. And from Wednesday more than R20. Consumers are barley surviving.”

Ethiopia declares state of emergency as Tigrayan forces gain ground

Ethiopia declared a six-month state of emergency on Tuesday after forces from the northern region of Tigray said they were gaining territory and considering marching on the capital Addis Ababa.

The announcement came two days after Prime Minister Abiy Ahmed urged citizens to take up arms to defend themselves against the Tigray People’s Liberation Front (TPLF).

Earlier on Tuesday, authorities in Addis Ababa told residents to register their arms and prepare to defend their neighbourhoods.

The state of emergency was imposed with immediate effect after the TPLF claimed to have captured several towns in recent days and said it might march on Addis Ababa, about 380 km to the south of their forward positions.

“Our country is facing a grave danger to its existence, sovereignty and unity. And we can’t dispel this danger through the usual law enforcement systems and procedures,” Justice Minister Gedion Timothewos told a state media briefing.

He said anyone violating the emergency would face three to 10 years in prison, for offences such as providing financial, material or moral support to “terrorist groups”.

Ethiopia last imposed such a measure in February 2018 for six months ahead of the transition of power to Abiy.
Curfews were enforced and people’s movements restricted, while thousands of people were detained.

The Addis Ababa city administration said people should register their weapons and gather in their neighbourhoods. House-to-house searches were being conducted and troublemakers arrested, a statement said.

“Residents can gather in their locality and safeguard their surroundings. Those who have weapons but can’t take part in safeguarding their surroundings are advised to hand over their weapons to the government or their close relatives or friends.”

Before the announcement, people moved around the capital as normal.

“I will try to buy food commodities in advance. But so far I haven’t yet purchased anything,” said one woman who asked not to be named.

The governments of four of Ethiopia’s 10 regions also called upon Ethiopians to mobilize to fight against the Tigrayan forces, state-affiliated Fana TV said.

The conflict in what was once considered a stable Western ally in a volatile region has plunged around 400,000 people in Tigray into famine, killed thousands of civilians and forced more than 2.5 million people in the north to flee their homes.

It erupted in the night of November 3, 2020 when forces loyal to the TPLF – including some soldiers – seized military bases in Tigray, a northern region.

In response, Abiy sent more troops there.

The TPLF had dominated Ethiopian politics for nearly three decades but lost much influence when Abiy took office in 2018 following years of anti-government protests.

Relations with the TPLF soured after they accused him of centralising power at the expense of Ethiopia’s regional states – an accusation Abiy denies.

TOWNS CAPTURED

TPLF spokesperson Getachew Reda said that if Tigrayan forces and their allies succeeded in removing the government, they would establish an interim government. “If the government falls, we will definitely have an interim arrangement.”

There would also need to be a national dialogue, he said, but Abiy and his ministers would not be asked to take part.

“They will have their day in court,” he said.

The TPLF has claimed the capture of Dessie, Kombolcha and Burka, all in the Amhara region, in recent days.

A government spokesperson disputed the capture of Dessie and Kombolcha but later released a statement saying TPLF “infiltrators” had killed 100 youths in Kombolcha.

Spokespeople for the government, military and the Amhara region did not return calls seeking further comment on Tuesday.

On Monday night, Tigrayan forces said they had linked up with fighters from an Oromo force also fighting the central government.

The Oromo are Ethiopia’s biggest ethnic group. Many of their political leaders are currently in prison.

UN Secretary-General Antonio Guterres is “extremely concerned” by the latest developments in Ethiopia, said UN spokesperson Stephane Dujarric said. “The stability of Ethiopia and the wider region is at stake,” Dujarric said.

US ALARM

The US Special Envoy for the Horn of Africa said on Tuesday Washington was alarmed by the deteriorating humanitarian situation in the north, including signs of famine, and urged all sides to find ways to de-escalate and let aid in.

Also on Tuesday, US President Joe Biden’s administration accused Ethiopia of “gross violations of internationally recognised human rights” and said it planned to remove the country from the African Growth and Opportunity Act (AGOA) trade agreement which gives it duty-free access to the United States.

Ethiopia’s trade ministry said it was “extremely disappointed” by the US move and called for a reversal by January.

“The Ethiopian government takes all human rights allegations seriously: we are looking at them and conducting investigations and we are committed to ensuring accountability,” it said.

IEC hopes to reach 90% of vote counting by Tuesday night

The Independent Electoral Commission (IEC) says 55% of the national vote has been counted by 21H00 on Tuesday night.

Updating members of the media on the progress pertaining to the results capturing process at its Operations Centre in Tshwane, IEC expects 90% of the national vote to be finalised by tonight and the remaining 10% to be done by Wednesday.

IEC CEO Sy Mamabolo says “The Northern Cape has completed 89% of its results, followed by Western Cape at 72% and in the third position comes Eastern Cape at 70%. The rest of the provinces’ completion rates range between 37 and 67%. At the level of capturing 78% of the results are already in the system waiting for scanning and auditing. We are still pursuing the target of reaching 90% still in the course of tonight.”

Electoral Commission of South Africa Media Briefing: 

Load shedding 

The IEC says it has been in contact with Eskom officials over the impact of load shedding on vote counting. Eskom earlier announced that stage two load shedding will be implemented until 05 AM on Wednesday.

IEC Commissioner Mosotho Moepya says, “Load shedding is always a concern to the extent that it has an impact on our ability to do things fast so we have been in discussions with the officials of Eskom and we sought to achieve an insulation of certain sites where our operations are continuing.”

Objections with IEC

Political parties have until 5 o’clock on Wednesday afternoon to lodge their objections with the IEC.

Counting is continuing across the municipality and all eyes are on the hotly contested eThekwini Municipality. Provincial electoral officer Ntombifuthi Masinga says the IEC is hoping to release preliminary results on Thursday and final results next week on November 8th.

“We are Section 65 in our Municipality Electoral Act which empowers political parties or ordinary members of the community to lodge an objection with useful they think there’s anything g that happened during g the voting process in any voting station that may have prejudice the credibility of the elections in that voting station. Both political parties and members of the public can lodge those objections. they are lodged directly with the electoral commission, and the commission will deliberate on these and make a ruling as quickly as possible.”
