Public Protector Mkhwebane says the DA’s accusations against her were baseless

Public Protector, Busisiwe Mkhwebane says when the Democratic Alliance’s (DA) spy allegations against her failed to materialise, the party started writing letters to the former National Assembly Speaker,  Thandi Modise.

She says the DA initially wanted her to be removed for incompetence and not for her fitness to hold office.

This is mentioned in her responding affidavit to challenge the applications for direct access in the Constitutional Court to appeal a High court ruling that was in her favour.

Both the DA and the Speaker want to be granted direct access to appeal the ruling by a full bench of the High Court in Cape Town in the Constitutional Court.

The high court ruled in favour of Mkhwebane on two constitutional grounds which related to the separation of powers and her right to have legal representation during a parliamentary inquiry into her fitness to hold office.

In her responding affidavit, Mkhwebane says the DA’s accusations against her were baseless. She says they stemmed from court cases against her and utterances made by judges in such cases.

Mkhwebane also says the Modise constantly failed in her constitutional duties to be impartial. She says Modise continued to accept the DA motions for her removal from office even when the rules for the removal of a head of a Chapter 9 institution were not in place.

The matter will be heard in the constitutional court on Monday.
